Additionally, topical products containing hemp-derived cannabinoids must include bittering agents to prevent misuse.


The Virginia Department of Agriculture and Consumer Services (VDACS) has been actively enforcing these regulations. According to recent reports, state officials issued fines totaling nearly $10.8 million to more than 300 hemp product retailers. These fines were primarily for selling products containing delta-8 THC, a compound that has gained popularity for its psychoactive effects.


Out of 424 inspected retailers, 346 were found in violation of the new state law, resulting in 17,715 recorded violations. The civil penalties have been significant, but as of now, only a small fraction of the fines has been collected.


This crackdown has created a challenging environment for hemp retailers in Virginia. Many businesses have faced significant financial penalties and have had to navigate the complex regulatory framework. Consequently, legal marijuana sales are not expected to begin until 2027 at the earliest. This delay has driven the demand for quasi-legal THC products, further complicating the market.
